Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms and Conditions (the “Terms”), together with any referenced policies, describe your rights and responsibilities when accessing or using our Services.

We make every effort to display products and descriptions as accurately as possible. However, colours, appearance, or packaging may vary depending on your device or screen settings.

All product descriptions, specifications, availability, and pricing are subject to change at any time without notice. We reserve the right to discontinue any product.

We do not warrant that any product will meet your individual expectations beyond what is expressly stated.


3. Orders

Submitting an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion.

An order is only confirmed once payment has been successfully received and processed.

Unless otherwise stated, prices exclude delivery charges, handling fees, duties, or taxes.

You agree to provide accurate billing information and authorise us to charge your selected payment method for all purchases.


5. Shipping and delivery

Delivery timeframes provided are estimates only and are not guaranteed.

Ownership and risk of loss pass to you once the product is handed over to the courier.

We are not responsible for delays, losses, or failures caused by third-party carriers or events beyond our reasonable control.


6. Intellectual property

All content available through our Services, including but not limited to logos, text, images, graphics, and design elements, is the intellectual property of Refreshed Like New or its licensors.

You may not copy, reproduce, modify, distribute, or exploit any content for commercial purposes without prior written consent.


7. Optional tools

We may provide access to third-party tools or services. These are provided on an “as is” and “as available” basis without warranties.

Your use of optional third-party tools is entirely at your own risk.

Any transactions or interactions with third-party websites are solely between you and the third party.


9. Relationship with Shopify

Refreshed Like New is powered by Shopify; however, all sales and transactions are conducted directly between you and Refreshed Like New. Shopify bears no responsibility for purchases, disputes, or claims relating to our products or Services.

11. Feedback and reviews

We reserve the right to correct any errors, inaccuracies, or omissions at any time, including after an order has been placed.


13. Prohibited uses

You agree not to use the Services for unlawful, fraudulent, abusive, or harmful activities. We reserve the right to suspend or terminate access for violations of these Terms.

We may suspend or terminate your access to the Services at our discretion. Provisions relating to intellectual property, limitation of liability, and indemnification shall survive termination.


15. Disclaimer of warranties

All products and Services are provided on an “as is” and “as available” basis unless expressly stated otherwise. We make no warranties of any kind, express or implied.


16. Limitation of liability

To the fullest extent permitted by law, Refreshed Like New shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Services or products.


17. Indemnification

You agree to indemnify and hold harmless Refreshed Like New, its directors, employees, affiliates, and partners from any claims or damages arising from your breach of these Terms or misuse of the Services.


18. Severability

If any provision of these Terms is deemed unlawful or unenforceable, the remaining provisions shall remain in full force and effect.


19. Entire agreement

These Terms, together with any referenced policies, constitute the entire agreement between you and Refreshed Like New.


20. Governing law

These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of South African courts.


21. Additional policies

21.1 30-day money-back guarantee

We offer a 30-day money-back guarantee on eligible devices, calculated from the date of delivery.

This guarantee applies only if:

  • The device is returned in the same condition as sold

  • There is no physical damage, liquid damage, or misuse

  • All original accessories, packaging, and documentation are included

  • The device has not been tampered with or altered

  • A return request is submitted within 30 calendar days of delivery

All returned devices are subject to assessment. If no fault is found, return courier and assessment costs may be deducted from the refund or charged separately.

The 30-day money-back guarantee does not apply to:

  • Brand new devices that have been activated or used beyond initial inspection

  • Devices with physical or liquid damage

  • Free gifts or promotional items

  • Clearance or final-sale items

Refunds are processed via the original payment method after assessment.


21.2 Free gift disclaimer

Any free gifts or promotional items provided with a purchase are complimentary and are not covered by warranty.


21.3 Promotional giveaways

Giveaways are promotional campaigns conducted by Refreshed Like New. No purchase is required to enter or win.

Winner selection, notification, response timeframes, prize fulfilment, forfeiture, amendments, and eligibility decisions are at the sole discretion of Refreshed Like New.

Prizes are provided as-is, carry no warranty, have no cash value, and are non-transferable.

Refreshed Like New shall not be liable for any loss, delay, or circumstance beyond its reasonable control affecting the giveaway.

By entering a giveaway, participants acknowledge and accept these Terms.


21.4 Device warranty agreement

Devices include a 12-month warranty from the date of purchase (invoice required).

Repairs will be carried out free of charge within the warranty period.

Replacement devices issued in months 10–12 carry a 3-month warranty.

Original box and accessories must be retained for exchanges.

Physical damage, liquid damage, negligence, misuse, or unauthorised repairs void the warranty.


21.5 FlexiPay / in-house finance terms

Where FlexiPay or any in-house finance option is offered:

  • Approval is subject to internal assessment

  • Devices remain the property of Refreshed Like New until paid in full

  • Instalments must be paid on or before the agreed due date

  • Non-payment may result in suspension, blocking, recovery, or cancellation

  • Payments made may be forfeited in the event of default

  • Devices may not be resold or transferred while under finance

  • Early settlement may be permitted at our discretion

Specific finance terms form part of a separate signed agreement.


21.6 Laptop, software and cybersecurity disclaimer

All laptops and computers are supplied in working condition at the time of sale and are tested prior to delivery.

The Refreshed Like New warranty does not cover faults, failures, performance issues, data loss, or damage caused directly or indirectly by:

  • Installation of third-party software, applications, drivers, operating systems, or updates not supplied or approved by Refreshed Like New

  • Malware, viruses, ransomware, spyware, or any other malicious software

  • Absence, disabling, expiry, or failure of antivirus or security software

  • User negligence, unsafe browsing practices, unauthorised downloads, or exposure to insecure networks

  • System misconfiguration, registry modification, or software conflicts

Customers are solely responsible for maintaining adequate cybersecurity measures, including installing and maintaining reputable antivirus software, performing regular updates, and safeguarding their data.

Refreshed Like New shall not be held liable for any loss of data, security breach, unauthorised access, or consequential damage arising from third-party software or cyber incidents.

Nothing in this clause limits any rights the consumer may have under the Consumer Protection Act, 68 of 2008, where such rights cannot be lawfully excluded.
